1. Acceptance of Terms

By accessing or using Echoes Live at https://echoeslive.manus.space (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and creators who access or use the Service.

2. Description of Service

Echoes Live is an interactive AI audio drama platform that allows TikTok LIVE creators ("Creators") to generate AI-powered story scripts and voice-acted audio, and to run real-time audience voting sessions during their TikTok LIVE broadcasts. Audience members ("Viewers") may participate in voting sessions through a dedicated voting interface.

The Service uses third-party AI services including OpenAI (for script generation) and ElevenLabs (for text-to-speech audio synthesis). The quality and content of AI-generated output may vary and is not guaranteed.

3. Eligibility

You must be at least 13 years of age to use Echoes Live. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

To use TikTok LIVE integration features, you must have a valid TikTok account and comply with TikTok's own Terms of Service and Community Guidelines. Echoes Live is not affiliated with or endorsed by TikTok.

4. User Accounts and TikTok Integration

You may connect your TikTok account to Echoes Live using TikTok Login Kit. By doing so, you authorize Echoes Live to access certain TikTok account information and, where applicable, your TikTok LIVE room data as described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to use Echoes Live to:

• Generate, distribute, or promote content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Generate content that infringes the intellectual property rights of any third party.
• Generate content that sexualizes minors or promotes violence.
• Attempt to circumvent, disable, or interfere with the security features of the Service.
• Use automated tools, bots, or scripts to access the Service in a manner that places excessive load on our infrastructure.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service for any commercial purpose without our express written consent.
• Violate TikTok's Terms of Service, Community Guidelines, or LIVE policies while using the TikTok integration features.

6. AI-Generated Content

Echoes Live uses artificial intelligence to generate story scripts and audio. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing content before broadcasting it to your audience.
• You own the story topics and prompts you provide. However, the AI-generated output is provided to you under a non-exclusive license for personal, non-commercial use within the Service.
• We do not guarantee that AI-generated content will be free from errors, offensive material, or intellectual property issues.
• You are solely responsible for the content you broadcast on TikTok LIVE using the Service.

7. Intellectual Property

The Echoes Live name, logo, design, and underlying software are the intellectual property of Echoes Live and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our express written permission.

The voice models used for audio synthesis are provided by ElevenLabs and are subject to ElevenLabs' own terms of service and usage policies.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Echoes Live does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated content.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECHOES LIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

9. Relationship with TikTok

Echoes Live is an independent third-party application and is not affiliated with, endorsed by, or sponsored by TikTok or its parent company ByteDance Ltd. Your use of TikTok's platform is governed by TikTok's own Terms of Service and Community Guidelines. Echoes Live is not responsible for TikTok's platform availability, policies, or any actions TikTok may take regarding your account.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason at our sole discretion.

You may stop using the Service at any time. You may also disconnect your TikTok account from Echoes Live through the TikTok app's connected apps settings.

11. Changes to These Terms

We may modify these Terms at any time by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
